1. General Provisions

1.1 These Terms and Conditions outline the rules and regulations for the use of #’s web page, located at https://fppv.net/ (hereinafter "the Web page").

1.3 These Terms and Conditions of the Web page are binding to all parties of the Web page: the producer of contents (hereinafter “the Merchant”), a natural or legal person who makes the purchase in the Web page (hereinafter “the Customer“) and the Web page, the mediator of the Merchant and the Customer.

1.4 The parties to the sales contract created on the Web page, if the Customer purchases the content (hereinafter „the Content“) sold in the Web page, are the Merchant and the Customer. # is authorized by the Merchant as a broker who sells the Merchant's Contents.

1.5 # may set additional terms or regulations to the web page of the Web page. Updated regulations will be published in # Web page, # will not notify the parties about the additional terms.

1.6 # may modify or amend these Terms from time to time. Amended version of Terms will be published, # will not notify the parties about the amended Terms.

1.7  By accepting these Terms, the Customer confirms that they have read the terms of the Sales Contract, agree to them and will follow them. The Customers shall read these Terms of the Web page, and shall accept these Terms, by ticking the checkbox on the Web Page.

1.9 The content and this website are hereinafter referred as the “Platform”.

1.10 Please read the Policy before using and uploading any content to the Platform. Use of the Platform is considered to be acceptance of all the Policy and confirmation that you are a legal representative of the legal entity and you have the right to enter into the agreement on behalf of the legal entity. If you do not agree to this Policy, you do not have the right to use the Platform.

 

2. Purchase process

2.1 It is possible to purchase Contents from the Web page that has a ‘Purchase’ link. Content prices are indicated next to the Content. The price and availability of the Content are subject to change at any time and without prior notice. If the Customer has placed their order before the price of the Content changes, the price valid at the time of the order shall apply.

2.2 # has the right to withdraw from a Sales Contract entered into via the Web page and not to hand over the Contents ordered in the following events: the Content is removed from the Web page or the price or qualities of the Contents have been displayed in the Web page incorrectly due a system error.

3. Placing an order and shopping cart

3.1 Add the desired Content to your shopping cart for ordering and fill in all the required fields. The total cost will be displayed on the screen. You can pay for your purchase via credit card settlement.

3.2 The agreement enters into force when the payment has been completed on FPPV website.

3.3 The Customer may change the quantity of the Contents in its shopping cart for Pay-Per-View contents. In the shopping cart, the Customer can also select contents and services that are related to the Contents.

3.4 Order confirmation should be declared by clicking on the ‘Proceed to Checkout’ button and the Customer will be directed to the payment page.

3.5 The Customer is also welcome to register for a membership or subscription on FPPV.

3.6 In order to confirm the order and finalize the purchase, payment should be made via credit card. The Customer declares to be very careful in placing its order, as this is very critical for the quick and uninterrupted transfer of the ordered contents.

3.7 A Sales Agreement is considered concluded from the completion of the settlement process of #, according to the confirmation of the order. # shall not process order confirmations that have not been paid in full.

 

4. Payment for the Contents

4.1 The Customer can pay for the paid services by credit card.

4.2 After the payment, the Web page will send The Customer an Order Receipt. Customers can find their invoice on their account page.

4.3 All the personal data disclosed in the course of visiting the # Web page and making purchases shall be treated as confidential information. The encrypted data communications line with banks ensures the security of the personal data and bank account information of the Customer. The representatives of # do not have any access to the respective encrypted data.

 

5. Delivery and handover of contents

5.1  The Contents will be available for the Customer at the URL after the purchase is finalized. Customers can find their purchased Content also from their purchased history.

5.2 The Customers should make sure that the contact data is correct in order to prevent delays and misunderstandings in the transfer of the Contents. # does not assume any liability for the misunderstandings if these have been caused by the inaccuracy or incorrectness of the data that The Customer submitted during placing The Customer´s order.

6. Right of withdrawal

6.1 The right of withdrawal shall not apply for sales contracts regarding digital content that is not delivered on a tangible medium.

6.2  If the transfer of the Content has begun with the prior expressed consent, the right of withdrawal expires immediately after the contractual performance of the bought Content has begun. The Customer should express its consent as a waiver of their right of withdrawal in the Web page.

6.3 If the Customer has not yet given the Consent for transferring a digital content and would like to exercise the right of withdrawal, the Customer must notify # of their decision to withdraw from the Sales Contract in a written application and send it by e-mail.

7. Principles of data protection and processing

7.1 # shall ensure the protection of the Customer’s data, including their personal data, and the use of the data in line with the procedure prescribed by the terms of the Privacy Policy.

7.2 The Customer confirms that they have read and agree to the terms of the Privacy Policy. Subject to applicable legislation and the provisions of the Privacy Policy, # shall have the right to process data (including personal data) without the consent of the Customer to the extent necessary for the use in the Web page, the performance of the Sales Contract or for ensuring the performance of the Sales Contract. Based on the above, # is, without the Customer’s separate consent, also entitled to: send the Customer notices related to the use of the services in the Web page, including such notices that are in the interests of the security of the Web page users; to store the data on the orders of the Customers who have logged in the Web page for the purpose of their better service and the verification of transactions, including, within reasonable time limits, the data on the orders that the Customer did not place during a session.

7.3 If the Customer has granted their consent for the use of their data for marketing purposes either by the entry into a Customer Contract or by any other declaration of intention (e.g. in self-service) that confirms their consent, # shall use these data subject to the terms and purposes set forth in the Privacy Policy, including for sending personal direct marketing, campaign and discount offers for Contents and services to the Customer electronically (e.g. by e-mail).

7.4  The Customer is entitled to withdraw their consent for the use of their data for marketing purposes at any time by sending a corresponding e-mail to #, or to decline further direct marketing offers by following the instructions in a direct marketing offer sent to their e-mail address.

 

8. Liability and dispute resolution

8.1 # is responsible for all damages incurred by violating these Terms and Conditions to the full extent determined by the applicable legislation in the Kingdom of The Netherlands.

8.2 The Customer is responsible for all damage incurred by violating these Terms and Conditions to the full extent determined by the applicable legislation in the Kingdom of The Netherlands.

8.3 Neither party is responsible for the damage incurred to the Customer as well as the Content transfer delays, should such damage or transfer delay be caused by circumstances beyond #´s control, and occurrence whereof # did not foresee and could not have possibly foreseen (Force Majeure).

8.4 # is not responsible for moral damage caused to the Customer by changing transfer conditions, prices or other terms with these Terms and Conditions.

8.5 # will not reimburse expenses of the Customer arising from assuming obligations to third parties.

8.6 # will not reimburse the Customer for not using the opportunities due to changed transfer conditions of Content, prices or other terms, within these Terms and Conditions.

8.7  The Customer has the right to submit complaints about non-compliant (defective) Contents to # within two (2) years from the date of handover (transfer). The complaint must be submitted immediately, but not later than within two (2) months from the discovery of lack of Content. Upon detecting a defect, the Customer must take reasonable measures to preserve and protect the Content, including not using defective Content if it would further worsen the condition of the Content.

8.8 If the Content does not comply with the Terms and Conditions of the Contract, the Customer may use legal remedies provided by law, including requesting the repair or replacement of the Content or withdrawing from the Sales Contract and returning the corresponding Content.

8.9 # is not responsible for: deterioration/damage to the Contents due to the Customer’s fault.

8.10 If the Content has been guaranteed by the # or the Merchant by warranty, the Customer will be provided with the written warranty conditions together with the Content and/or made available electronically on the Web page.

8.11 In order to solve any subsequent problems, the Customer must keep the purchase documents (invoice, contract, etc.) confirming the purchase of the Content from # Web page. # has the right not to solve the problem if there is no purchase document.

The Customer can contact the Consumer Disputes Committee to resolve disputes. The Consumer Disputes Committee is authorized to resolve disputes arising from agreements concluded between the Customer and # which have not been settled by negotiations between the parties.

8.15 Disputes are settled mutually. If mutual settlement of disputes is not possible, disputes will be handled by the Dutch Courts in the Netherlands in accordance with Dutch legislation.

 

9. Intellectual property rights

9.1 Unless otherwise stated, # and/or its Merchants own the intellectual property rights in all material contained on the Web page. All intellectual property rights are reserved.

 

10. Software/hardware requirements

10.1 The following minimum requirements are required for using the Content:

11. Adult Content

11.2 FPPV adheres to the following policies when posting adult content.

11.2.2 We require all suppliers to be in compliance with the 18 U.S.C. §2257 Record Keeping Requirements. And, all suppliers must submit If you would like to inquire the supplier about their content within Service, please contact us using our form for assistance.

11.2.3 Suppliers who publish Adult Contents on FPPV are required to submit an identification document issued by a public institution to FPPV. Supplier shall submit copies of records of the ages of those persons portrayed in any sexually explicit materials, and FPPV confirm those documents before the content will be published.

11.2.4 All adult contents are moderated by FPPV. All adult contents are reviewed by FPPV both manually and automatically by AI technology to ensure the contents comply with the Governing law and the terms of use. This site does not provide access to videos depicting: Rape/Brutality, Incest, Pedophilia, Bestiality, Necrophilia, Drugged/Incapacitated sex, Blood/Mutilation.

 

12. Child Sexual Abuse Material Policy

12.1  FPPV has a zero-tolerance approach for any materials that consist of children being sexualized, exploited, or endangered. These materials, referred to as CSAM(child sexual abuse material) includes but not limited to media, text, and illustration. CSAM are strictly prohibited on our platform and is in violation of our Terms of Use. Any detected CSAM are reported to the National Center for Missing and Exploited Children (NCMEC), where reports for law enforcement agencies are produced.

We have multiple controls in place to ensure CSAM is not shared within our platform. However, if you believe a possible CSAM is made available, please report it to the following email address. A prompt investigation will take place and the content will be dealt with accordingly.

13. Non-Consensual Content Policy

13.1 The uploading of adult related material without the consent of all parties involved is in violation of our Terms of Use and is strictly prohibited.

As part of the Mastercard regulation related to adult contents, in addition to the eKYC process of the supplier covered in 11. Adult Content of Terms of Use, we require all adult content to include the identification document of the performer and also a consent agreement.

14. Other provisions

14.1 Content images are for illustrative purposes only.

14.2 Content prices and availability are subject to change without advance notice. In connection with the first, # reserves the right to cancel the sale transaction and refund the money to the Customer’s bank account within a reasonable time.

14.3 The Web page of # reserves the right to cancel the sales transaction if one of the following content problems has occurred: a human error in entering the price or technical error in the system.

14.4 Content information is verified and updated regularly.

It is possible that the data has been updated since the last visit of the Customer.

It is possible that the content information on the # Web page may be inaccurate.

In this event, the # Web page does not accept any responsibility for the accuracy of the internal data.
